E-mail disclaimer

E-mail messages from Simac are exclusively intended for the addressee(s). Simac’s e-mail messages (including any attachments) are company property and may be confidential or otherwise protected from publication. Any unauthorised use, reproduction or distribution of the message (in whole or in part) is expressly forbidden. If you have mistakenly received an e-mail from Simac, we would request that you inform the sender of this immediately by e-mail or by another means. We would also request that you immediately delete this e-mail and any attachment(s) from your system.

Anti-spam and email filtering

Simac makes use of filters, which are frequently automatically updated, against viruses, spam, exploits and other digital threats. All incoming e-mails to Simac that have sufficient characteristics of these types shall be deleted or blocked:

  • e-mail that contains a virus will immediately be deleted;
  • e-mail source check using several international RBL ‘blacklist’ databases. On receipt the filter blocks such an e-mail and sends a standardised (SMTP) technical report back to the mail server that sent it. NB: it is the responsibility of the sender to ensure that their mail server is removed from the RBL blacklist(s) in question;
  • blocking of internationally known ‘vandal’ files;
  • blocking of e-mails containing files that can be run in them;
  • keyword filtering for undesired words or character combinations in the e-mail subject (Subject) and/or the message itself (Body). Such e-mails land in a temporary e-mail quarantine buffer and can still be released by the recipient for a few days.

Due to Simac’s e-mail filtering, but also because, within the Internet, mail is filtered for digital threats by Internet Service Providers, among others, it is possible that your e-mail might not reach Simac, whether wholly or in part. We would therefore advise, if there is any doubt in the case of an important e-mail to Simac, or a file sent to Simac, that you check whether the message and/or file has been received in good order.

Privacy - general

Simac ICT Belgium offers a variety of different services. By the nature of the services offered to our customers, we collect certain personal data. We believe that the protection of this personal data is essential to our provision of services. For this reason, we have included the following privacy policy information about how we process the personal information of our applicants and website visitors.

This privacy policy applies to all personal data that Simac collects during interactions with Simac: such as when someone visits the site, uses services offered by Simac, purchases Simac products and services from us, subscribes to newsletters, contacts customer service, applies to a job, and so on.

What do we use personal data for?

Simac uses personal data only for the purposes of efficient and effective operation. We ask customers and potential customers to share personal data with us for the following purposes, including but not limited to:

  • In order to answer any questions or complaints
  • To agree upon and implement the optimization of our products, services, website and customer service
  • To activate or register certain products or services, or to expand their functionality
  • In order to process your application
  • The facilitation of access to information
  • Compliance with legal obligations
  • To conduct a customer satisfaction survey
  • To contact for promotional purposes, including sending newsletters and invitations to events
  • To create interest in us as a possible future employer, customer or supplier
  • To deploy security programs
  • For (statistical) analysis and reporting (see ‘Use of cookies’ below)

What data is processed by Simac

During your interaction with Simac, we may ask questions or request certain personal data. We collect only the data necessary for the provision of our services. These data include, but are not limited to:

  • name, e-mail address, telephone number, function, (business) address and/or (business) account number
  • future communication preferences of Simac
  • information about the products and/or services that you have purchased or have shown interest in
  • depending on preferences on social-media sites: information on online activities and social media profiles
  • personal information collected through cookies (see ‘Use of cookies’ below)

Unless they have the permission of a parent or legal guardian, we have no intention of collecting information from persons under the age of 16 years. However, we are not always able to verify that someone is older than 16. We encourage parents to be involved in the (online) activities of their children, in order to prevent the collection of data pertaining to children without parental consent.

We do not keep data longer than is permitted by law and which is necessary for the purposes for which we use your personal data. The specific period depends on the nature of the personal data and the purposes for which they are processed. We take the protection of your data seriously and take appropriate measures to prevent abuse, loss, unauthorized access, disclosure and unauthorized alteration.

Sharing personal data with others

If you are a customer of Simac, it is possible that we may share personal information with other Simac operating companies to expand or complete the existing services we already provide.

In addition, we may share personal information with business partners and other third parties. If approval is required by law or if we consider it appropriate to do so, we will ask for your approval before sharing personal data. We may only share personal data for the following purposes:

  • As regards the granting or execution of our services:
    · To help us deliver our products and services, we link business partners and other third parties.
    · We will inform you in advance of this cooperation. To the extent that these third parties may have access to your data, we have contractual and organizational measures in place to ensure that data are protected and may be used only for specific purposes.
  • To improve our services, website or advertisements
    · We use software from other parties to measure how well a new product page succeeds. Telephone calls may be recorded for quality purposes.
  • To obtain feedback
    · We sometimes use survey offices to better understand how satisfied customers are with our services.
  • To perform a legal obligation
  • We never sell information to third parties

Rights

Individuals have the right to see, correct or delete shared personal data (If this is legally permissible and practical). In addition, consent for data processing may be withdrawn for anyone objecting to the processing of his/her personal data by Simac. Individuals also have the right to data portability.

If you file a request, Simac will ask you to identify yourself to prevent abuse. We will respond to you as soon as possible, within four weeks at the latest, to address to such a request. We would also like to point out that everyone has the opportunity to submit a complaint to the supervisory authority.

If people do not wish to receive commercial messages from Simac, they can let us know by checking the relevant box on the form or by using the unsubscribe link in the e-mail that was sent.

Use of cookies

We make use of cookies on our website. Cookies are small text files that are stored upon the first visit to our website on your computer, tablet or smartphone. We use cookies that are necessary for the technical operation of our website as well as for the ease of use of the user. We also use cookies to optimize our website. Where possible, we may use the information we obtain through cookies – with the consent of the user – to provide information that best suits the interests of the visitor to our site.

This privacy statement relates specifically to the job website of Simac NV (url: https://www.jobssimac.be).

We want candidates to trust us without any concerns, which is why we are dedicated to protecting privacy to the fullest extent.

To ensure we deliver the highest quality service and perform our job effectively, we collect certain personal data from our candidates and service users. It goes without saying that we handle this data very carefully, all the while managing it  securely and respectfully.  Exactly what data is involved, how long we keep it and for what purposes can be read below in our privacy policy.

People should have control over their own personal data, which is why we want to give everyone the chance to decide which data you want to share with us and which you do not.

The General Data Protection Regulation of 27 April 2016 (the GDPR), the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (‘Privacy Act’) and the Act of 13 June 2005 (‘Electronic Communications Act’) and  its implementing decrees regulate the protection of your personal data.

2. What does ‘processing of data’ mean and who is responsible for it?

By ‘processing of data’ we mean any processing of personal data. The term ‘processing’ covers, among other things, the collection, recording, organisation, storage, updating, alteration, retrieval, consultation, use, dissemination or making available by any means, alignment, combination, archiving, erasure or ultimate destruction of personal data. Simac is the data controller for your personal data.

3. What data do we process?

‘Personal data’ means data relating to an identifiable individual (the ‘data subject’) that you give to us yourself, that we assign to you for the use of our products and services, that we obtain through the use of our products and services, or that we have received through third parties. We assume that information provided by third parties is accurate and reliable and that these third parties have a valid legal basis for sharing this data with Simac.

We distinguish between different types of personal data. They allow us to offer and improve our products and services wherever possible:

  • Candidate data: this allows us to identify or contact you. For example: your name, your address, your phone number, your language preference, your gender, your email address, your age, your family composition and any other preferences you express through social media, promotions, mobile applications, etc;
  • Data linked to career and related expectations: educational level, knowledge, skills, experience, salary and salary expectations, references from previous employers, etc.
  • Data relating to health: these are requested only if necessary for the vacancy for which the candidate is applying;
  • Data relating to a criminal record: these are requested only if necessary for the vacancy for which the candidate is applying.

As required by law, we do not process sensitive data such as data about your racial or ethnic origin, political views, sexual preferences, among others.

4. Why do we process your data?

We process personal data for various purposes. In doing so, we always process only the data necessary to achieve our intended purpose. This is how we use personal data:

Website contact form

   When you contact us via the contact form on our website, we process your personal data in order to manage and answer your queries. The processing of your personal data in this case is based on our legitimate interest, in particular fulfilling your request after you address us. 

Temporary employment or recruitment

      Simac processes contact details and personal data of candidates for the purpose of offering temporary employment or recruitment to those candidates. The processing of this data for our internal records is based on our legitimate interest, which is to find a suitable candidate for a position. If this data is transferred to third parties, such processing is based on performance of the contract or on your explicit consent.

Answering questions about vacancies

   When candidates ask Simac questions about a vacancy, we process your personal data in order to answer your question as completely and correctly as possible. The processing of your personal data in this case is based on our legitimate interest, in particular fulfilling your request after you address us. 

Candidate data analysis

  We process personal data of candidates in order to offer you, as a candidate, suitable vacancies and to introduce the suitable candidate to our clients. This processing is based on your explicit consent. 

Application

   If you provide Simac with personal data within the framework of an unsolicited application, this data will be collected and processed for the purpose of handling the further recruitment process. This includes personal data derived from CVs and cover letters. This processing is based on your explicit consent. 

Active recruitment

    In the context of recruiting potential candidates through social media channels, our website, trade fairs, etc., we process certain personal data of these potential candidates. Only if they declare that they wish to cooperate with Simac in finding a suitable vacancy will we process their personal data. This processing is based on their consent. 

Special categories

    If we process ‘special categories’ of personal data in accordance with Art. 9 and 10 GDPR, such as, for example, medical data if this may affect your employment, we will only process this data with your explicit consent. If you request us to process this data or if you disclose this data yourself, we will only process this data if it is necessary for our services. 

5. Use of cookies

 Simac collects your data when you visit our website or when you click on a link in an email. We do this through the use of cookies, or similar forms of technology that enable us to do so. 

 You can disable the use of cookies by using the cookie banner and the settings of your web browser. However, know that in that case the website may not work quite correctly or may be slower. 

6. How do we secure your data?

  We assure you that our security policy for handling personal data is always up-to-date with the latest standards, effectively protecting against unauthorised access, disclosure, or loss. 

 7. Confidentiality

  To meet these objectives, only authorised personnel have access to personal data. These individuals may only process the data as necessary to achieve the stated purposes. 

 Simac guarantees that it has implemented adequate practical and organisational measures to ensure the confidentiality of data within its operations. 

   Conversely, Simac expects each candidate to maintain the confidentiality of information obtained regarding job vacancies and future employment opportunities.
This information should not be disclosed to third parties and must remain confidential while in the candidate’s possession or control. 

 The candidate also agrees not to approach or contact, either directly or indirectly, any companies that have posted a vacancy, including their owners, shareholders, employees, representatives, suppliers, customers, competitors, banks, or consultants, without prior formal approval from Simac.   

 8. Do we sell or transfer your data to third parties?

We do not sell personal data to third parties nor do we pass it on to third parties unless:

  • to our legal successors and other companies within the Simac group;
  • this is required for our services. For example, we provide data to customers when we think it is necessary to fill a vacancy;
  • to other companies we cooperate with to provide certain Simac services. For example, we provide data to the hosting company of our website, to companies managing marketing projects for us, to companies providing legal and accounting services for Simac, etc.;
  • we have a legal obligation to do so;
  • we obtain explicit consent from you.

 In case of international transfer of personal data, we protect your data according to the level of protection required by European regulations.  

9. Retention period

 Simac will retain and process your personal data for a period necessary for the performance of the agreement and in function of the purposes of the processing, as described above.  

  For our customers’ contacts, we apply a retention period that runs concurrently with the period during which that person is active as a contact person with that customer. This is to ensure continued optimal service and follow-up. 

 10. What are your rights and how can you exercise them?

You have various rights regarding the personal data we process about you. 

You can exercise these rights by contacting us using the contact details provided under 11. 

As part of our identification obligation, we may ask you to provide us with a copy of your identity card. 

Right of access and correction

 If you would like to know which personal data Simac processes about you and for which purposes, please contact us. You can also request that any incorrect personal data be corrected or that your data be changed. 

Right of erasure and restriction

   You have the right to ask us to delete your personal data. Certain data may be retained by Simac after your request for erasure. For example, because we have a legal obligation to keep the data for a certain period of time.  

 If you have legitimate reasons to do so, you may ask us to restrict the processing of your personal data. For example, because you dispute the accuracy of your data.  

Right to object

  If the processing of your personal data is based on our legitimate interests or is necessary for fulfilling a task in the public interest or under public authority, you have the right to object to this processing with valid reasons. 

Right to data portability

     If we process your personal data based on your (explicit) consent or as part of fulfilling our agreement with you, you can request to receive your personal data in a structured, commonly used, and machine-readable format. You may also ask us to transfer this data to another controller, provided the processing is done through automated means. 

Right to withdraw consent

    If the processing of your personal data by Simac is based on your (explicit) consent, you have the right to withdraw this consent again at any time. However, the withdrawal of your consent does not affect the lawfulness of the processing prior to the withdrawal of your consent.

Right to lodge a complaint

 You have the right to complain to the Data Protection Authority if you have a complaint about Simac’s use of your personal data:

 It goes without saying that the processing of personal data may evolve over time as a result of amended legislation, technical progress, …
